Trademark/Trade Dress
Is your product's shape, color, and/or size recognized as an indicator of source by the ordinary consumer of those types of products? If so, you may want to consider protecting those characteristics. Trade dress is the branch of trademark law dealing with a product's distinctive features, including color, size, shape, texture and weight. For example, we helped one client obtain trade dress protection for the unique look of its signature product: BUBBLOPE®, a reusable mailing envelope that comprises Bubblewrap® covered with a shiny Mylar® coating that forms a distinctive surface pattern of repetitive, circular depressions.
