BUBBLOPE® envelopes
During a visit to Taiwan in the late 1980s, our client Design Ideas, Ltd. noted the popularity of screens used behind a car's windshield to keep the inside of the car from heating up while parked in the sun. These screens consisted of reinforced Bubblewrap® layered with a bright plastic coating that reflected the sun's rays. Our client thought that the screens were attractive, and invented the notion of designing mailing envelopes out of the same material. The result was BUBBLOPE®, a signature product for our client. Our client handed out thousands of samples of BUBBLOPE® as a premium product in trade shows over the years, and many millions have been sold in a multitude of sizes and colors, to mail everything from a CD to a picture frame to a thick file folder. When we undertook representation for this client, the time for obtaining a patent was long gone. However, the product was so distinctive, the client was able to obtain two U.S. trademark registrations - U.S. Reg. No. 2,233,126 and U.S. Reg. No. 2,885,545 - to protect the trade dress of this product. These registrations, the first of which has become incontestable, have formed the backbone of several successful enforcement efforts to combat knock-offs.
